Resumen:
Los hechos jurídicos penalmente relevantes antes de las Sentencias No. 18-18-IN/24 y No. 2706-16-EP/21 constituían una categoría jurídica muy poco comprendida y estudiada en la práctica penal ecuatoriana. Las limitadas referencias dogmáticas, normativas y jurisprudenciales impedían apreciar la magnitud de sus contenidos y la enorme incidencia en aspectos sustanciales del proceso penal que ostentan raigambre constitucional entre los cuales merece la pena mencionar: el derecho del imputado a ser informado en forma previa y detallada y en lenguaje sencillo de las acciones iniciadas su contra, la congruencia penal, el derecho a la defensa, la proporcionalidad de la pena y la satisfacción del estándar de suficiencia motivacional de las decisiones fiscales de imputar y acusar.
Por esa razón esta investigación tiene como objetivo principal establecer la gran contribución de la jurisprudencia constitucional mencionada en la práctica penal y en la definición y determinación de los hechos penalmente relevantes que deben ser imputados y acusados por la Fiscalía General del Estado.
La metodología emplea el enfoque cualitativo porque interesa la descripción, comprensión, recopilación y análisis de las cualidades de los hechos con relevancia penal, y resulta pertinente para analizar la jurisprudencia constitucional y el problema antes precisados. Finalmente, se propone una Guía para la determinación de los hechos con relevancia penal elaborada exclusivamente sobre las previsiones hermenéuticas jurídico-penales de las Sentencias No. 18-18-IN/24 y No. 2706-16-EP/21, la cual constituye un instrumento útil y valioso para alcanzar el nivel de precisión técnica, claridad y completitud, normativa y jurisprudencialmente exigidos en el sistema penal ecuatoriano.

Penally relevant legal facts prior to judments No. 18-18-IN/24 and No. 2706-16EP/21 constituted a legal category that was poorly understood and within ecuadorian criminal practice. Limited docmatic, statutory, and jurisprudential references prevented and full appreciation of the magnitude of its contest and its profound impact on substantive aspects of criminal process rooted in constitutional principles. Among these, it is worth mentioning: the defendan´t right to be informed beforehand, in detail, and in simple language of the actions initiated against them; criminal consistency (congruencia penal); the rigth to defense; the proportionality of punishment; and the fulfillment of the motivational sufficiency standard in prosecutorial decisions to charge an indict.
For this reason, the main objetive of this research in to establish the significant contribution of the aforementioned constitutional jurisprudence to crimminal practice, as well as to definition and determination of penally relevant facts that must be chargerd and indicted by the State Attorney General's Office.
The methodology employs a qualitative approach, as it focuses on describing, understanding, compiling, and analyzing the attributes of facts with criminal relevance, rendering it pertinent for analyzing both the constitutional jurisprudence and the aforementioned problem. Finally, a Guide for the Determination of Facts with Criminal Relevance is proposed, developed exclusively based on the legal-criminal hermeneutic provisions of Judgments No. 18-18-IN/24 and No. 2706-16-EP/21. This guide serves as a useful and valuable instrument to achieve the level of technical precision, clarity, and completeness required by statutory law and jurisprudence within the Ecuadorian criminal system.
