Resumen:
El presente artículo tiene por objeto el análisis de la importancia de la formación vial en cada uno de los niveles de educación, considerando que según el Artículo Cuarto de la Ley Orgánica de Transporte Terrestre Tránsito y Seguridad Vial se hace referencia a la formación y educación vial como parte fundamental de la seguridad. En su desarrollo se describe la naturaleza jurídica y las políticas públicas vigentes en el país, encauzadas a la garantía de la formación vial en los niveles educativos, además se evalúa el cumplimiento de las garantías constitucionales pertinentes al derecho a la educación y capacitación vial. La metodología utilizada fue cuali-cuantitativa, dado que se revisó el marco legal ecuatoriano, a la vez que consideró la percepción de los actores involucrados de forma directa o indirecta en el ámbito de la formación vial. Esta información fue contrastada con la literatura en materia de Derecho y Ciencias Sociales, para brindar un aporte de carácter crítico en procura de alcanzar los objetivos planteados.

The purpose of this article is the analysis of the importance of road training at each level of education, considering that according to Article Four of the Organic Law of Land Transportation, Traffic, and Road Safety, road training and education are fundamental part of security. In its development, the legal nature and the public policies in the country are described, aimed at guaranteeing road training at educational levels, and it is also assessed the compliance with the relevant constitutional guarantees to the right to road education and training. The methodology used was qualitative-quantitative, given that the Ecuadorian legal framework was reviewed, while considering the perception of the actors directly or indirectly involved in the field of road training. This information was contrasted with the literature in the field of Law and Social Sciences, to provide a critical contribution in order to achieve the objectives set.
