Resumen:
El presente estudio tiene por objetivo determinar mediante la doctrina y el marco legal nacional e internacional, si se aplicó o no una reparación integral al ciudadano Michael Arce dentro de la sentencia No. 17124-2014-0585 por el delito de odio racial. Este ciudadano, ingresó como cadete a la Escuela Superior Militar “Eloy Alfaro” (Esmil) en el año 2011. Sin embargo, su meta se vio truncada ya que fue víctima del delito del odio por razones étnicas y discriminación por parte del teniente instructor, quien, además de someterlo a una serie de prácticas humillantes, instigó a los otros cadetes para que lo despreciaran. Esta situación afectó el estado emocional y psicológico del cadete, tanto, que solicitó la baja de la Escuela Militar. Este estudio busca, mediante una introducción, tres capítulos y unas conclusiones, determinar el marco cronológico de los procesos judiciales que afrontó Michael Arce con el fin de defender sus derechos. Desarrollar un marco teórico y jurídico alrededor del concepto de reparación integral y, finalmente, analiza si la sentencia No. 17124-2014-0585 por delito de odio tuvo o no una reparación integral efectiva.

The objective of this study is to determine, through the doctrine and the national and international legal framework, whether or not a comprehensive reparation was applied to citizen Michael Arce within sentence No. 17124-2014-0585 for the crime of racial hatred. This citizen, entered as a cadet to the Military High School "Eloy Alfaro" (Esmil) in 2011. However, his goal was truncated since he was a victim of the hate crime for ethnic reasons and discrimination by the instructor lieutenant, who, in addition to subjecting him to a series of humiliating practices, instigated the other cadets to despise him. This situation affected the emotional and psychological state of the cadet, so much so that he requested discharge from the Military School. This study seeks, through an introduction, three chapters and a few conclusions, to determine the chronological framework of the judicial processes that Michael Arce faced in order to defend his rights. Develop a theoretical and legal framework around the concept of comprehensive reparation and, finally, analyze whether sentence No. 17124-2014-0585 for hate crime had or not an effective comprehensive reparation.
